"सुप्रीम कोर्ट ने यूपी सरकार को बड़ा झटका देते हुए कहा कि सरकारी अफसर को भी मौलिक अधिकार है कि वो अपनी सरकार के खिलाफ जनहित याचिका दाखिल कर सकता है। सुप्रीम कोर्ट ने यूपी सरकार की उस याचिका पर टिप्पणी की जिसमें IPS अमिताभ ठाकुर को दस्तावेज वापस लौटाने के खिलाफ अर्जी दी गई थी।"
लखनऊ बेंच का आदेश जिसके खिलाफ राज्य सरकार माननीय उच्चतम न्यायालय की शरण में गयी थी।

Heard the petitioner in person and learned Chief Standing Counsel as well as Sri Mahendra Kumar Mishra, learned counsel appearing on behalf of Union of India.
Learned Chief Standing Counsel prays for and is granted four weeks' time to file counter affidavit.
List after four weeks.
The petitioner has specifically stated in paragraph no.19 of the writ petition that he has demanded documents under Right to Information Act.
It is to be noted that the petitioner has demanded documents under Right to Information Act, but the State Government has failed to provide any document in that regard. After having failed to obtain the documents under Right to Information Act, the petitioner has moved an application for supplying the necessary documents, which in his opinion are necessary to defend himself during the course of enquiry, which is proceeding against the petitioner.
Learned Chief Standing Counsel states that those documents are not relevant.
The petitioner, who appears in person, submits that in article of charges all those documents have been mentioned.
In these circumstances, opposite parties are obliged to supply the documents within four weeks and if some documents are voluminous, then it will be open for the State Government to permit the petitioner to inspect the same. Till the documents are not supplied, enquiry against the petitioner will not proceed.
